  1. EBEV.COM PTY LTD (ABN 51 169 880 960) (“eBev”, “we”, “us” and “our”) is the operator of the website and online platform at https://ebev.com (“Site”). Please read this privacy policy carefully as it explains the way in which we manage and handle personal information, including information collected through the Site. eBev is subject to the Australian Privacy Principles (“APPs”), which are set out in the Privacy Act 1988 (Cth) (“Privacy Act”). We will handle your personal information in accordance with the APPs.

  2. We may revise this Privacy Policy from time to time. We will display a notice on the Site indicating when any such revisions have been made. 

The Site is intended for licensed, wholesale purchasers of wine and beverages within Australia only. Persons under the age of 18 are not permitted to use this Site. 

What personal information does eBev collect and hold?

Collection of personal information by eBev

eBev operates the Site for the wholesale wine and beverage trade, aggregating portfolios from leading wholesale wine and beverage suppliers (“Suppliers”) for licensed venues such as restaurants, bars, hotels and retailers (“Venues”). The Site provides the online platform through which licensed Venues can efficiently, conveniently and directly connect with a large range of Suppliers and their products.

To facilitate the sale and purchase of wholesale wines and beverages between Suppliers and Venues on the Site, we collect a range of personal information, including the following:

  1. the name, title and contact details (such as email address and phone number) of our Site users including Suppliers and Venues who register with the Site;

  2. records of communication between us, Suppliers and Site users, including any records of email or phone enquiries;

  3. personal information about individuals that represent Suppliers and Venues (for example the name, email address and phone number of authorised sale representatives);

  4. the Site registration details of individual Site users;

  5. payment information from Suppliers and Venues who register for eBev trade services; and

  6. Site use information. We collect and use IP addresses to analyse trends, administer the Site, track users’ movements, and gather broad demographic information for anonymous and aggregate use. If you wish to disable ‘track users’ movements’, you can opt-out here. Opting out will create a cookie that tells the FullStory software to turn off recording. The presence of this cookie is required to continue opting out, so if you clear your browser cookies, you will have to opt-out again. Please note, we encourage you to leave this on as this allows us to make the Site better for you.

We do not collect any sensitive information about individuals. 

Please note that while we seek to minimise the personal information we collect, if you do not provide us with the personal information we request, we may not be able to provide you with the services or other assistance you seek. 

Collection of personal information by Suppliers

Suppliers will generally collect personal information about you when you purchase their products through the Site. The primary purpose for the collection of this information is to facilitate the purchase and delivery of the products you have ordered.  All Suppliers are located in Australia.

Suppliers bound by the Privacy Act are required to maintain their own privacy policies.  You should review Suppliers’ privacy policies if you require further information as to how they collect, use and disclose personal information. 

Our use of Cookies

We also collect data about your Site usage through the use of cookies and other technologies. Cookies are alphanumeric identifiers that we transfer to your computer’s hard drive through your web browser to enable our systems to recognise your browser and to provide certain functionality to enhance your user experience.

We may use anonymous data that we collect through cookies and other technologies to assist Suppliers to provide Site users with targeted information about their products.

We may also share the anonymous data that we collect through the use of cookies and other technologies with other entities so that they can provide you with targeted advertising as you browse the Web. 

In particular, we use Google Analytics features (including Google Remarketing, Google Display Network Impressions Reporting, the Double Click Campaign Manager and Google Analytics Demographics and Interest Reporting) on our Site, which use both first party and third-party cookies to record standard internet traffic information.  We, and some third parties (including Google), also use the information to optimise ad selection for groups of individuals based on age, gender, interests and past visits to our Site.  The cookies allow us and other third parties (including Google) to evaluate your interactions with ad services on our Site and serve targeted advertising on sites across the Internet. We have enabled Google Analytics for Display Advertising which allows Google and other third parties to advertise to you on our Site and across the Internet.

We also use first-party cookies (such as Google Analytic cookies) and third-party cookies (such as the DoubleClick cookie) to report how our ad impressions, other uses of ad services, and interactions with these ad impressions and ad services are related to visits to our Site.  In addition, we use data from Google’s Interest-based advertising or third party audience data (such as age, gender, and interests) with Google Analytics to help us understand how user activity varies based on these factors.

By using Google Ad Settings (www.google.com/settings/ads), you can opt-out of the Google features described above at any time and customise your Google Display Network Ads.  Alternatively, you can opt out of a third party’s vendor’s use of cookies by visiting the Network Advertising Initiative opt-out page (see http://www.networkadvertising.org/choices/#completed).

The Help portion of the toolbar on most browsers will tell you how to prevent your browser from accepting new cookies, how to have the browser notify you when you receive a new cookie, or how to disable cookies altogether.  Additionally, you can disable or delete similar data used by browser add-ons, such as Flash cookies, by changing the add-on’s settings or visiting the website of its manufacturer.  However, because cookies allow you to take advantage of some of the Site’s essential features, we recommend that you leave them turned on. 

How do we collect and hold personal information?

Generally, we endeavour to collect personal information directly from the individuals concerned.  However, if this is not practicable, we may collect personal information from Suppliers.

We may also collect personal information (including credit information, personal contact and identification details) from Venues in commercial credit applications that are made available by Suppliers or third party credit providers on the Site. For the Venue’s convenience, this information will be stored in connection with their eBev account for use in completing subsequent commercial credit applications. 

eBev also collects personal information about Suppliers from Site users and Venues purchasing the Supplier’s’ products on the Site. This information generally takes the form of reviews and feedback about the performance of Suppliers and the products they sell.

If we collect personal information about individuals from other individuals or entities, we will take reasonable steps to ensure that the relevant individuals are made aware of the collection of their personal information.

eBev takes reasonable steps to ensure the security of your personal information. In particular, eBev encrypts communications between the Site and end users by way of an industry-standard SSL certificate, which prevents third-party interception of user data as it is transmitted to the user. Users’ passwords are also stored and protected using stringent security measures.

It is important for you to protect against unauthorised access to your password and to your computer. Be sure to sign off when you finish using a shared computer.  Any data destroyed is disposed of in an appropriate manner that protects the privacy of your information.

eBev stores personal information about Site users on Amazon Cloud Servers, which are located in Australia.

Why do we collect, hold, use and disclose personal information?

The primary purpose for which we collect, hold, use and disclose personal information is to provide the Site and facilitate the sale and purchasing of wine and beverages through the Site. 

We may also collect, use, store and disclose your personal information for the purposes of:

  1. facilitating your registration as a Site user;

  2. administering and maintaining your eBev account;

  3. conducting, improving, maintaining and developing business and customer relationships with other entities and individuals, including with Venues and Suppliers who use our Site;

  4. meeting our legal obligations;

  5. sending Venues and Site users communications confirming and summarising their orders, or information about Site updates;

  6. responding to individuals’ queries;

  7. marketing the services we provide, and providing individuals with information about the products available on our Site;

  8. creating data analysis and industry reports; and

  9. for Venues: processing payment instructions, managing the Venue’s credit account (where applicable) and the collection of amounts outstanding by Venues by a third party debt collector, and enabling a third party credit provider to access Venue’s billing statements, account information, payments and Site transactions.

To give effect to the purposes described above, eBev may disclose your personal information to the following individuals and entities:

  1. Suppliers, who sell products through the Site and deliver products you have ordered to you. We share customer information related to those transactions with the relevant Supplier. Please read the Suppliers’ privacy policies to find out how they handle personal information.

  2. Service providers, which we engage to perform services on our behalf. We provide our service providers with access to your personal information, but only to the extent it is necessary to the services they provide to us.

  3. Offshore disclosures. At present, we do not disclose personal information to persons or entities located outside Australia. If this practice changes, we will notify you by amending this Privacy Policy.

  4. Any other entities if you have given your consent.

We may otherwise disclose your personal information to entities if such disclosure is required by, or authorised under, the Privacy Act.

Further disclosures of personal information (credit reporting agencies)

Venues agree that eBev may, to the extent permitted under the Privacy Act, disclose the credit reporting information of Venues (relating to credit provided to Venues for payment of products purchased from Suppliers on the Site) to a credit reporting body for the purposes of obtaining a credit reporting information about the Venue; and allowing a credit reporting body to create or maintain a credit reporting information record about the Venue.

Venue’s credit information that may be disclosed under this paragraph includes the Venue’s personal particulars; details of the credit;
credit eligibility information, credit reporting body derived information, repayment history information, information on any amounts overdue and for which debt collection action has been started; information on any overdue amounts that have been remedied; and information that, in the opinion of eBev, the Venue has committed a serious credit infringement.

The Venue’s credit information may be disclosed to eBev’s related entities or other third-party credit providers, whether or not an account is overdue and, if necessary, its risk insurers, debt collectors and credit reporting agencies. If all or part of the information requested is not provided, the Venue may not be considered for any credit application or have access to credit facilities for purchases on the Site.

Venues acknowledge and agree that eBev may make enquires (either by eBev or by a third party engaged by eBev) as to its credit and financial situation and further agrees to the use of any information obtained as a result of those enquiries, including information disclosed in the credit application for the purposes set out in this paragraph.

What about other websites lined to our Site?

From time to time our Site may contain links to the websites of other entities. If you click on such links, you will be transferred to the websites of these entities. We have no control over and are not responsible for, the privacy practices of these entities, or for the practices employed by websites linked to or from our Site, or the information or content contained therein. 

Please remember that when you use a link to go from our Site to another website, our Privacy Policy is no longer in effect. Your browsing and interaction on any other website, including websites that have a link on our Site, is subject to that website’s own rules and policies. You should read the privacy policy of these entities to find out how they handle your personal information when you visit their websites.

Acquisition or changes in Ownership

In the event that the Site or platform (or a substantial portion of its assets) are acquired, your information would be considered part of those assets, and may be part of those assets that are transferred to the acquirer.

How can you access and correct your personal information?

Under the Privacy Act, you have the right to:

  1. seek access to the personal information that we collect and hold;

  2. ask us to update or correct your personal information when it is inaccurate, incomplete, or out-of-date; and

  3. opt-out of receiving direct marketing communications from us.

If you wish to access the personal information that we hold about you, please set out your request in writing, and send it to: admin@ebev.com. Please note that we may charge reasonable fees to cover the administrative cost of retrieving and providing access to your personal information.

If you are of the view that personal information we hold about you is inaccurate, or out-of-date, or if you have other queries about accessing and correcting your personal information, please contact us using the contact details noted above.

If you would like to access and correct the personal information Suppliers hold about you, you should contact the relevant Supplier directly using the contact details provided on the Supplier’s page.

Making a complaint

If you wish to make a complaint about how we handle your personal information, please contact us at admin@ebev.com, setting out your complaint in writing. If you wish to make a complaint about how a particular Supplier has handled your personal information, please make your complaint to that Supplier directly.

We will deal with all requests for access to personal information or complaints as quickly as possible and will endeavour to get back to you within a reasonable time frame.

If you are not satisfied with our response to your complaint, you may lodge a complaint with the Office of the Australian Information Commissioner (“OAIC”) via their website at http://www.oaic.gov.au/.
